This course will examine and assess the laws and regulations in New York State, the United States, and certain other jurisdictions around the world, designed for students to learn about, understand, and apply concepts related to electronic advancements and technology, and how they impact the inter-related worlds of business and law. Is your business operating in Europe, or soliciting customers from Europe? Then be aware of the provisions of the European General Data Protection Regulation (GDPR). Operating in New York? Then the SHIELD Law should be of concern. California’s Consumer Privacy Act should be understood. In addition, a message/e-mail/post may live on for years, and become a key piece of evidence in a business dispute, employment discrimination claim, or criminal proceeding. The course will address obligations for cloud storage of data; legal regulation related to social media; preservation of electronic materials in legal disputes; and how electronic and social media information is used as evidence in both civil and criminal matters.
